Terms of Service

3.1 Free Tier and Cloud Trial: All authenticated users receive permanent free access to local transcription, including Whisper and Parakeet models, Ollama AI enhancement, history, presets, hotwords, and 90+ language support. No payment method is required to sign up. Users who upgrade to a Whisper Pro monthly or yearly subscription receive a 7-day Cloud trial that unlocks OpenAI Cloud transcription, Cloud AI enhancement, and web search; the card supplied at upgrade is not charged during this 7-day window.

3.2 Monthly Subscription: Monthly recurring subscription providing access to all features and models.

3.3 Yearly Subscription: Annual recurring subscription at a discounted rate, providing access to all features and models.

3.4 Lifetime License: One-time payment providing perpetual access to all features and models, including future updates.

3.5 Team Plans: Multi-seat subscriptions (5, 10, or 20 seats) with centralized billing and team license management. Available in monthly and yearly billing cycles.

3.6 Account Requirements: You must provide accurate information and maintain the security of your account. You are responsible for all activity under your account.

4.1 Monthly Subscription Fees: Billed monthly in advance. Your first charge occurs after the 7-day Cloud trial ends. Local transcription remains free regardless of subscription state.

4.2 Yearly Subscription Fees: Billed annually in advance. Your first charge occurs after the 7-day Cloud trial ends. Local transcription remains free regardless of subscription state.

4.3 Lifetime Fees: One-time payment with no recurring charges.

4.4 Team Plan Fees: Billed monthly or annually depending on the plan selected. All seats are billed together under a single invoice.

4.5 Refunds: We offer a 30-day money-back guarantee on all plans. See our Refund Policy for full details.

4.6 Payment Processing: All payments are processed securely by Stripe. We do not store your credit card or payment information.

4.7 Price Changes: We reserve the right to modify pricing with 30 days notice to existing subscribers. Price changes do not affect active lifetime licenses.

5.1 License Grant: We grant you a non-exclusive, non-transferable license to use the Service in accordance with your subscription tier.

5.2 Restrictions: You may not reverse engineer, redistribute, or resell the Service.

5.3 Device Limitation: Each individual license may be used on up to 3 devices at a time. Team plan seats are each valid for one device. You can manage your registered devices from the desktop app or by contacting support.

5.4 Commercial Use: Monthly, Yearly, Lifetime, and Team licenses permit commercial use. Free trial is for evaluation purposes.

6.1 Local Processing: All transcription is performed locally on your device.

6.2 No Audio Upload: We do not upload, store, or have access to your audio recordings or transcriptions.

6.3 Account Data: We store your email, subscription status, and device registrations to provide and secure the Service.

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful or malicious content
• Attempt to gain unauthorized access to our systems
• Share license keys with unauthorized users
• Use automated tools to abuse the licensing or payment systems

9.1 Service Availability: We do not guarantee uninterrupted or error-free service. License validation and updates require an internet connection.

9.2 Accuracy: Transcription accuracy may vary depending on audio quality, language, accent, and model selection. We do not guarantee 100% accuracy.

9.3 Warranty Disclaimer: THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

9.4 Liability Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10.1 How to Cancel: You may cancel your subscription at any time using one of the following methods:

• Through the Stripe customer portal (accessible from the Whisper desktop app under Account settings)
• By emailing whisper@remskill.com with your account email

10.2 Cloud Trial Cancellation: If you cancel during the 7-day Cloud trial period, you will not be charged. Your Cloud feature access continues until the trial period ends, after which your account remains on Free with full local transcription.

10.3 Subscription Cancellation: When you cancel a monthly or yearly subscription, your access continues until the end of the current billing period. No further charges will be made after cancellation.

10.4 Team Plan Cancellation: Team plan cancellation takes effect at the end of the current billing period. All team member seats will lose access at that time. The team admin should notify members before cancelling.

10.5 Termination by Us: We may suspend or terminate accounts that violate these terms.

10.6 Effect of Termination: Upon termination, your access to paid features will cease at the end of the current billing period. Lifetime licenses remain valid unless terminated for violations. Your transcription data remains on your local device and is not affected by account termination.
